Howe+Co continue to be the leading solicitors representing former members of HM Armed Forces and the Gurkha community continuing to fight the historic injustice caused by the failure of the Government to provide for settlement of individuals that have served in the Army.
Howe+Co conducted the groundbreaking legal and political campaigning (alongside the famous actress, Joanna Lumley) for retired British Army Gurkha’s, seeking the right to settle in the United Kingdom.
The first in the line of decisions is the judgement of Limbu & others v SSHD [2008] EWHC 2261. This judgement fundamentally set the bar for all cases and identified the historical injustice in the case.
The next decision was the Ghising decision in the Upper Tribunal [2012] UKUT 160 (IAC), which again developed the issue of historic injustice. In 2013 the Upper Tribunal again revisited Ghising in [2013] UKUT 567 (IAC).
The most recent decision is that of Rai v Entry Clearance Office [2017] EWCA Civ 320
