We are one of the few firms that continue to hold contracts to represent those detained under legal aid. We will also see clients paying privately who have been held for a period of detention. In addition, we will assist our clients in pursuing claims for unlawful detention where appropriate.
In all cases the Home Office must justify the detention both initially and thereafter review it regularly. Some cases, the law prevents the authorities from being allowed to detain you, without exceptional justification.
It may be against the law to detain you in the following circumstances:
- You are an unaccompanied minor
- You have a severe disability which cannot be handled in detention
- You have an infectious or contagious disease
- You are a woman who is 24 weeks or more pregnant
- You suffer from a mental illness
- You require constant medical care that cannot be provided in detention
- There is evidence that you have been the victim of torture or trafficking
If you fall into any of these categories and have been detained by the immigration authorities, you may be able to claim monetary compensation from them.
Legal aid may be available to you to pursue a claim for unlawful detention against the Home Office. Our Immigration solicitors will be able to advise you on the merits of your claim, likely compensation available and whether or not you will qualify for Legal Aid.
If you do not qualify for Legal Aid we may be able to assist you on a no win no fee arrangement by entering into a conditional fee arrangement agreement.
