At Howe+Co,  our team of dedicated military solicitors is recognised for our legal expertise and determination to secure justice for service personnel. We go beyond where others may stop, ensuring that members of the armed forces receive the specialised legal guidance they need.

You may be entitled to compensation if you have suffered an illness or injury due to the Ministry of Defence’s (MoD) failure to provide proper protection. Our legal services cover many military-related claims, including military deafnesscold and heat injuries, and more. Additionally, we offer wills, probate services, and independent financial advice to help military personnel and veterans plan for the future.

Unlike the Armed Forces Compensation Scheme (AFCS) or War Pension Scheme, we pursue civil claims, often in parallel with these no-fault government schemes, to help maximise your compensation.

Military Accident Compensation Claims

Military service is inherently dangerous, but this does not exempt the MoD from its duty of care. If you were injured in a non-combat military accident, you may be entitled to compensation for your suffering, financial losses, and long-term impact on your life.

Common Military Accidents

Our military accident lawyers specialise in claims related to the following:

  • Road traffic accidents
  • Training exercises and drills
  • Parachuting and aviation accidents
  • Explosions and fires
  • Faulty equipment or weapons malfunctions
  • Sports and adventure training injuries
  • Chemical exposure and hazardous materials
  • Medical negligence during treatment

You have the right to claim compensation if you were injured while serving, whether on or off duty. Our legal team offers free, no-obligation consultations, and most cases are handled on a no-win, no-fee basis.

Non-Freezing Cold Injuries (NFCI) Claims

Military personnel often serve in harsh, wet, and cold environments for extended periods. This can lead to non-freezing cold injury (NFCI), trench foot injury, or cold weather injury. If left untreated, NFCI can cause permanent damage to the nerves and blood vessels, resulting in chronic pain, sensitivity to cold, and even medical discharge.

Symptoms of NFCI

  • Numbness or tingling in hands and feet
  • Pain upon warming up
  • Swelling, redness, or a yellowish appearance
  • Increased sensitivity to cold

MoD’s Duty of Care

The Ministry of Defence is responsible for protecting service members from NFCI by:

✔ Educating personnel on prevention and early detection
✔ Providing appropriate boots and gloves
✔ Limiting unnecessary exposure to cold and wet conditions
✔ Allowing time to dry and warm up
✔ Promptly identifying and treating NFCI symptoms

Can You Claim Compensation?

Many service members are unaware they can pursue a civil claim alongside a War Pension or AFCS claim. Crown Immunity, which previously protected the MoD from legal action, was lifted in 1987. You may have a strong case if you served after this date and suffered NFCI due to negligence.

Even if your AFCS or War Pension claim has been denied, you may still be eligible for civil compensation.
